Before completing the form, please note that ESMA’s action in response to complaints is unlikely to directly resolve your personal situation, e.g. ESMA’s action will not lead to the payment of redress or compensation. The purpose of a breach of Union law investigation is a general one, i.e. to ensure that going forward, the practices of the concerned NCAs are brought fully into line with Union law. Please also note that ESMA is not obliged to open a breach of Union law investigation under Article 17 of the ESMA Regulation, even if it considers that a breach has occurred.
In order to directly resolve your personal situation, or be awarded compensation, you should consider taking action locally, in the Member State concerned. Submitting a complaint to ESMA does not suspend the time limits for starting legal action under national law.
