ESMA-webformulier voor klachten over inbreuken op het Unierecht

Gebruik dit formulier om een klacht in te dienen tegen een nationale bevoegde autoriteit (NBA).
NB: Velden waar “verplicht” bij staat moeten worden ingevuld. U kunt uw klacht pas indienen als al deze velden zijn ingevuld.
Voordat u het formulier invult, is het goed er even bij stil te staan dat de actie die ESMA onderneemt naar aanleiding van klachten uw persoonlijke situatie waarschijnlijk niet direct zal oplossen en bijvoorbeeld niet zal leiden tot de uitbetaling van vergoedingen of compensatie. Met een onderzoek naar een inbreuk op het Unierecht wordt er in het algemeen naar gestreefd de toekomstige praktijken van de betreffende NBA’s volledig in lijn te brengen met het Unierecht. Wees u er ook van bewust dat ESMA niet verplicht is een onderzoek naar een inbreuk op het Unierecht in te leiden krachtens artikel 17 van de ESMA-verordening, zelfs als zij van mening is dat er inderdaad sprake is van een inbreuk.
Als u uw persoonlijke situatie direct wilt oplossen of compensatie wilt ontvangen, overweeg dan om lokaal actie te ondernemen, in de betrokken lidstaat. Een klacht indienen bij ESMA schort de tijdslimieten voor het nemen van juridische stappen krachtens het nationale recht niet op.
