The European Securities and Markets Authority (ESMA), the EU’s securities markets regulator, will hold an open hearing for its consultation papers on the Recovery regime under CCPRRR on 14 September 2021.

The European Securities and Markets Authority (ESMA), the EU’s securities markets regulator, launched on the 12 July 2021 seven public consultation papers on the recovery regime established under CCPRRR, with the aim to gather stakeholder feedback on how to implement the recovery mandates that ESMA has been given under CCPRRR.

The seven consultation papers contain, among others, proposals for Draft Regulatory Technical Standards (RTS) on the methodology for calculation and maintenance of the additional amount of pre-funded dedicated own resources, Guidelines on the consistent application of the triggers for the use of Early Intervention Measures as well as Guidelines on CCP recovery plan indicators and scenarios.

The closing date for responses is 20 September 2021. ESMA will consider the responses to the consultation with a view to publishing the final reports by Q4 2021/Q1 2022.

This open hearing, chaired by Nicoletta Giusto (CCP SC Independent member), aims at providing an opportunity for interested stakeholders (such as CCPs, clearing members, and other entities that are subject to or impacted by the recovery regime as set out under the CCPRRR) to discuss the proposals in advance of providing consultation responses.
