The tool will guide you in understanding whether your entity may fall within the scope of the ESG Rating Providers Regulation.

An ESG rating means an opinion or a score, or a combination of both, regarding a rated item’s profile or characteristics with regard to environmental, social and human rights, or governance factors, or regarding a rated item’s exposure to risks or impact on environmental, social and human rights, or governance factors. It is based on both an established methodology and a defined ranking system of rating categories, irrespective of whether such ESG rating is labelled as “ESG rating”, “ESG opinion” or “ESG score”. If you think your entity issues such a product or service, please proceed through the decision tree below to understand whether you are in scope as an ESG rating provider.

Is it issued on a professional basis?
Issued on a professional basis where the entity’s activities include issuing and publishing or distributing ESG ratings as a professional or commercial service.

This tool aims to help entities self-assess whether they may fall within the scope of Regulation (EU) 2024/3005, in accordance with Articles 2 and 3 thereof. It is provided purely for information purposes, does not constitute legal or other advice, and is without prejudice to ESMA’s specific assessment of each case. Entities should not rely solely on this tool to make compliance decisions and ESMA does not assume any liability for its content.
