Issued on a professional basis where the entity’s activities include issuing and publishing or distributing ESG ratings as a professional or commercial service.

Do you issue or distribute ESG ratings to EU regulated financial undertakings/undertakings under Directive 2013/34 or 2004/109 / Union or Member State authorities?

This includes distributing ESG ratings (for example by contract or subscription) to EU regulated financial undertakings, entities under EU accounting or transparency directives, or Union or Member State authorities.

Are the ESG ratings distributed at the EU user’s own exclusive initiative?

Own exclusive initiative means the EU user approached the provider without any solicitation, marketing, or advertising by the provider.

Does the distribution permit recurrent distribution to the user or distribute to any other user in the Union?

Recurrent distribution means the arrangement would permit repeated distribution to the same user or to any other user in the Union.

Do you have substantial market share in the EU or a website in an official EU language not customary in international finance?

Is there a substitute for these ratings offered by an ESG rating provider authorised under the Regulation?

A substitute refers to a comparable ESG rating available from a provider authorised under the Regulation.

Labelling activities without disclosing an ESG rating?

Applies where only a label is provided without disclosing an ESG rating.

Non-profit and non-commercial publication?

Provided that the non-profit does not charge rated items or issues of rated items to report data or to get rated through their platform, or charge users of ESG ratings to access any information on ESG ratings.

External reviews or second-party opinions on sustainable bonds without an ESG rating

External reviews or second-party opinions on environmentally sustainable or sustainability-linked bonds, loans or other debt instruments marketed as sustainable, where the review does not contain an ESG rating issued by the reviewer or opinion provider.

External reviews of European Green Bonds

Activities expressly excluded

Data-only services, data products, credit ratings, investment research, mandatory SFDR or Taxonomy disclosures.

ESG ratings issued by an authorised ESG rating provider and published or distributed by a third party

Applies where ESG ratings are issued by an ESG rating provider authorised under the Regulation, and such ratings are subsequently published or distributed by a third party.
